About Workers' Compensation

New York State’s Workers’ Compensation Law establishes a system designed to provide wage replacement and medical benefits to those who suffer work-related injuries or illnesses. It was intended to ensure that injured workers receive compensation for lost wages, medical expenses, and rehabilitation costs resulting from workplace accidents or occupational diseases.

The law mandates that employers carry workers’ compensation insurance to cover these expenses. In exchange for mandatory workers’ compensation coverage, the law precludes injured workers from suing their employers for personal injury arising out of and in the course of employment.

Unlike personal injury lawsuits, who is at fault is irrelevant in a workers’ compensation case, which means employees are entitled to benefits regardless of who is responsible for the injury or illness so long as the injury or illness arose from and during employment. In addition, the Workers’ Compensation Law does not allow recovery for pain and suffering.
